Court Allows Miami-Dade Count to End

MIAMI (AP) - A state appeals court Wednesday night upheld a decision by an exhausted Miami-Dade election board to drop its manual recount, an attorney for the board said. Democrats promised a state high court appeal. The board decided to stop counting votes just hours after it agreed to count only disputed ballots to save time. Murray A. Greenberg, a lawyer for the election canvassing board, said a state appeals court turned down a bid by Democrats to force the board and vote counters to get back to work.

Less than a day after the Florida Supreme Court ruled that Secretary of State Katherine Harris must extend the deadline for hand recounts before certifying the state's presidential election winner, Florida's Speaker of the House Tom Feeney announced that he was considering intervening in the election crisis. "There is increasingly compelling evidence of widespread mischief, human error, vote and ballot manipulation in the manual recount process," Feeney told reporters Wednesday afternoon. "One of the reasons the Florida legislature was so clear in having a very definite deadline set out in statute, which the court has decided to ignore, is to make certain we never had to be in a position where you had the charade that is going on now."

WASHINGTON (Reuters) - The campaign of Democrat Al Gore said on Wednesday that it would immediately seek to overturn the Miami-Dade County decision not to resume a recount of presidential ballots, a move which could jeopardize Gore's hopes for the White House. Campaign manager William Daley told reporters outside the vice president's residence in Washington, ``We will immediately be seeking an order directing the Dade County Board of Canvassers to resume the manual recount.''

Oral Arguments in Brevard County Suit Set for Next Week

Oral arguments in a lawsuit filed in the 11th Circuit Court of Appeals by Brevard County Bush voters could be heard as early as next Wednesday, NewsMax.com has learned. The voters' lawsuit, Touchston vs. McDermott, is separate but similar to the Bush campaign lawsuit, Siegel vs. LePore, which is also before the 11th Circuit in Atlanta. In the lawsuit, three Brevard County voters argue that Florida law, under which manual recounts are being conducted, violates their constitutional rights.

Bush will not request a presidential election recount in Wisconsin, where an unofficial tally shows he lost to Vice President Al Gore by more than 5,000 votes, campaign chairman Don Evans said Wednesday. ``The race there was indeed close, but Gov. Bush will do his part to help bring this election to a conclusion,'' Evans said.

It took two weeks and a breathtaking repudiation of the rule of law, but it looks like Al Gore finally grabbed the brass ring. God bless him, because if the multifaceted assault on any reasonable definition of fairness handed down by Florida's highest court last night stands - and if Gore goes on to win the White House - he's going to have to govern. And that won't be easy. Because what happened last night in Tallahassee - again, if it stands - was a coup d'etat. The Florida Legislature - as a matter of law - long ago established a deadline for the certification of election results in the Sunshine State. That deadline was crystal clear going into the election: Seven days after Election Day. This year's certification date - Nov. 14, 2000 - did not meet the needs of Al Gore and the Democrat Party. So the Florida Supreme Court set a new date: Nov. 26, 2000.

Bush: 'Court Rewrote the Law'

TALLAHASSEE -- Republican Texas Gov. George W. Bush blasted the Florida Supreme Court for having "changed the rules" two weeks after Election Day, and some Florida legislators said they would consider calling a special session to try to nullify the court's ruling. Bush said the court usurped the authority of Florida election officials and improperly changed state law. Bush now plans to appeal the Fla. Court's decision to the United States Supreme Court on the grounds that the Fla. Court violated the separation of powers requirement of the U.S. Constitution.
