Power, The Source of Law
Forget the Constitution

A local policeman stopped me last night three blocks from my home at a "T" intersection with three stop signs. It seems I had rolled through the stop sign. My car was the only one visible at the intersection; the other two entry roads were empty. Had I refused to present my license and registration I would shortly have been handcuffed and lead off to jail.

Several years ago, I wrote the following about my experience with the local police:

"Remembering my understanding that no license was required to operate the scooter, I told the officer that I did not think I needed to show him my license. This statement seemed to trigger a vindictive streak in this fine looking young man. He demanded my license and immediately brought his ticket writing pad to the ready. A bit upset, I struggled to get my license from my wallet. It seemed stuck in the stitched slot. By the time I got my license unstuck, another unmarked vehicle had pulled alongside the police car and a man in civilian clothes was conversing with the handsome officer who had now returned to his cruiser. For ten minutes or so I sat on my scooter while my wife's coffee got cold. I got off my scooter and approached the police car to see what was holding things up. The man in civilian clothes ordered me back to my scooter. Presently a County Sheriff's vehicle pulled up and out climbed the most imposing physical specimen I have seen in a long time. Well over 6 feet, trim, and very strong looking. After exchanging some papers with the City Police Officer, he too informed me that I could not operate my scooter on the sidewalk."

"Following a long wait the Officer emerged from his vehicle presented me with a traffic ticket and informed me that I would be required to pay a fine of $78.00 and receive 3 points against my Drivers License or as an alternative, I could attend a drivers improvement course. He said quite emphatically, that I had not shown him proper respect.

Devvy Kidd is an entertaining writer with a keen mind and a sizeable following. She has written an article with the riveting title "Heil Hitler! It has begun". It tells of a woman named Deborah Davis who refused to produce identification for Homeland Security Police outside a Federal Center in Colorado. The woman was handcuffed, removed from the bus, detained for a couple of hours, and ticketed for noncompliance to regulations that "citizens must, when requested, display Government or other identifying credentials to Federal police officers or other authorized individuals;" also, they must comply with "the lawful direction of Federal police officers and other authorized individuals."

Kidd also cites the recently announced intention of Miami police to stage random shows of force at "hotels, banks, and other public places" in an attempt to keep "terrorists" guessing and remind people to be vigilant."

In response to these blatant totalitarian measures, she cites the Constitution and a number of legal decisions.

Tyranny is in place when the citizenry must respect the government rather than the government respecting the citizenry.

Essays attempting to inform a complacent and unteachable citizenry about their loss of freedom and impending subjection to a despotic state no longer serve a utilitarian purpose; tyranny is already functional in America. Those who wield the power are bent on enslaving the world, puny protests mean nothing to them and those who are subjected to the power have proved to be beyond redemption.

America's citizens and those who write for their consumption need to understand that the Constitution and the Bill of Rights are no longer valid. Our legal system has overruled them for several decades. The police officer who stops you for a traffic violation has almost unlimited power but he knows nothing of your Constitutional rights. Although they can stop you, detain you, search you, and deprive you of your dignity and freedom, the even more egregious Federal inspectors at the airport neither know nor care that the laws they enforce violate the legal rights of citizens. Up a step in the broken system, judges that preside over the courts into which the neo-Gestapo bring citizens have no interest in the Constitution their concern is to enforce the unconstitutional laws that are already on the books.

In the Congressional debates, concerning the current War in Iraq powerful long-time congressman Henry Hyde referred to the Constitutional requirement that Congress declare war as "anachronistic". Hyde is not the only congressman who holds this opinion. The majority of our representatives regularly vote for legislation that is unconstitutional. The freedom robbing USA Patriot Act passed the House by a vote of 357 to 66 and the Senate by 98 to 1. Hyde did not mention what law has superseded our Constitution but it is not hard to answer that question: Power determines law!

Power is the impetus behind the war in Iraq. Neither the overarching Laws of our Creator, nor International Laws of warfare stand against the ugly face of power. The fact that most Americans oppose the war means nothing, it will continue because power sustains it. Already the potential Democratic Presidential candidates are expressing their support for the war.

Torture is a result of the law being overcome by power. When law becomes anachronistic, the base nature of man is soon evident and when it grows to its full height, submission becomes a matter of life or death.

Government is by nature tyrannical and when it slithers out from under legal control, it quickly becomes lethal. From the beginning, America has shown signs of imperialism. Acquiring the land on which our fifty states reside was not without breaches in righteous behavior. The New World was colonized in the Seventeenth Century and after over two hundred years America's indigenous Indians were still a major problem. They thought the land they had occupied for centuries belonged to them and as a result resisted the incursions of Europeans. In the end, all legal restraints gave way to wars resulting in the slaughter of hundreds of thousands of Indians and ultimately their submission to confinement on reservations. From their perspective, it was an illegal, unrighteous, crime against humanity carried out by superior armaments and superior numbers - power made the law!

Secretary Rumsfield has labeled Iraqi resisters "terrorists"; America's Indians were labeled "savages". When Americans resisted the British during the Revolutionary War they were know as "Patriots" and soldiers who killed the Indians become American leaders. Power determines who is good and who is bad.

The creation of the nation of Israel by the Balfour Agreements and the United Nations created a similar problem in the Middle East. Our war against the Indians lasted for over two hundred years. Israel's war against the Palestinians has now gone on for over fifty years. Israel has the armaments but the Arabs have superior numbers. The crafty Israeli's have now succeeded in bringing America's numerical superiority to bear against the Arabs. Immutable law does not govern this conflict; power makes the law!

Nearly a hundred men, women and children were needlessly burned to death during the government siege of the Branch Davidian Compound in Waco, Texas. Power proclaimed this travesty legal and no one was held accountable.

Though not always cowardly, acts of terrorism often involve retaliation against innocent people, they are dastardly, hideous, and immoral. It is a tactic used against superior forces and is often the only effective response. American Indians used it and the Palestinians are now using it. Superior forces ultimately defeated the American Indians but it remains to be determined whether America and Israel have the power to defeat and oppress two hundred million Arabs. One thing is certain; doing so will require history's most massive slaughter.

To those who hold the reigns of power the outcome may not matter. If America wins and the Arabs come under American control, the unseen power structure that controls America will force it into world government. If America is defeated, it will be weaker and easier to control.

The American Constitution and its already maligned legal system will not provide an obstacle to the nefarious forces of world domination and those who cry for its enforcement are crying into the wind.

The Prophet Jeremiah brought God's Word to ancient Israel; the word was that all should yield to the subjugation of King Nebuchadnezzar of Babylon. "Hearken not unto them; (false prophets) serve the king of Babylon and live; wherefore shall this city be laid waste?" Jeremiah 27:17

American voters have elected and re-elected the George W. Bush regime. They have voted to continue the encroachment of despotism and must now live under it. Fighting it is futile. The very people Americans elected put the procedures for stemming resistance in place. God has always been willing to give His subjects what they want but very often when they get it; it is not what they anticipated.

The pagan mind might benefit from reviewing the history of the actions of powerful secularists. God intended that His creation vest all power in Him. Power vested in the creature is misplaced and quickly misused. Legitimate Power belongs to God and His Law is His vehicle for exerting it. They are the rules under which human power is to be restrained, when they are obeyed peace and prosperity result, when they are ignored tyranny, murder, mayhem, and confusion result. This premise is validated each day in the land that once was a "city on a Hill".

Truth is still needed but the American Constitution is beaten, bloodied, and only half-alive. Any sign of life and the murderers will club it again.
