Pay Close Attention to Padilla Case
Lee Shelton / The Backwater Report:José Padilla was held by the Pentagon from May 2002 until January 2006. He was then transferred to the custody of the U.S. Justice Department where he was indicted on terrorism charges. His trial is scheduled to begin next month – five years after his arrest. Padilla filed a motion to dismiss on the basis that the government denied him his right to a speedy trial. But Judge Marcia Cooke denied the motion, holding that his status as an “enemy combatant” while in military custody precluded that right.
