District Attorney Kermit McManus said Friday it is unlikely he will seek the death penalty against a Resaca man accused of smothering his wife's 5-month-old son. "This does not sound like it would be a case where the district attorney could seek the death penalty," McManus said. The most commonly used aggravating circumstance is for a murder to involve torture, but that doesn't seem to apply to this case, he said.
