James C. Kopp's request for a
public defender who agrees with his views on abortion has been turned down by a federal judge. In a decision late Thursday, U.S. Magistrate Judge Hugh B. Scott refused to appoint a new attorney to defend Kopp on federal charges relating to the 1998 killing of Dr. Barnett A. Slepian. In June, Kopp asked Scott to replace William G. Clauss, a federal public defender, citing differences of opinion over defense strategy and over the issue of abortion. According to court papers, Kopp has refused to communicate with Clauss or even accept letters from him since July 3.

MONTGOMERY, Ala. - The mobile home and pickup truck of accused serial bomber Eric Robert Rudolph contained traces of the same type of explosive used in a deadly abortion clinic bombing in Birmingham that has been linked to Rudolph, court documents show. Investigators searching Rudolph's rented trailer in Murphy, N.C., in February 1998 found ethylene glycol dinitrate - the primary explosive ingredient in one type of dynamite - on a towel, a dark baseball cap and a cushion from a rocking chair, according to an affidavit attached to the original indictment against Rudolph.

About 25 people toting graphic signs depicting bloody, aborted fetuses picketed on West Street in Parole yesterday, leading to a few verbal confrontations and complaints but nothing serious enough for police to intervene. The protesters stood at the intersection with Route 2 from about noon to 2 p.m. as part of a five-day Washington-area campaign. The group also appeared in Glen Burnie, Perryville, Bel Air and White Marsh. The 3-by-5-foot signs depicted blown-up photos of aborted fetuses, some with severed body parts and caved-in skulls. Some drivers complained to the protesters and county police that the images were too graphic for adults or children to see.

A new state policy that bans the renewal of specialty license plates has triggered complaints and confusion, state officials said Friday.
"We can't issue any specialty plates, we can't reissue them if lost, we can't renew them and we can't transfer them," said Michelle Rayburn, a spokeswoman for the state Office of Motor Vehicles. The new rules stem from a 3-week-old federal court decision. U.S. District Judge Stanwood R. Duval Jr. of Houma ruled that the State of Louisiana's system of awarding specialty plates is a breach of free-speech rights. He ruled that the violation stemmed from the Legislature's decision to issue a "Choose Life" anti-abortion tag but not issue an abortion-rights license plate.

A 19-year-old Sandy woman who gave birth to a baby in a toilet, then placed the child in a plastic garbage bag, pleaded guilty Friday to third-degree felony child abuse. Stephanie Marie DeLuca claims she was unaware she was pregnant, and says she believed her baby son was born dead. But the child survived, despite spending an estimated 53 minutes inside the garbage bag on March 2, 2003. Named Tyson DeLuca, the boy reportedly is thriving physically and has shown no signs of major brain damage.

Every once in a while a news story will just push all the wrong buttons and I must address it at length. On July 29 the Yankton News in Yankton, SD published a story about a man that has been a quadriplegic for 27 years and his plans to go to China for promising treatment according to the article. The man’s name is Leo Hallan who according to the article is a Christian. Hallan explains, "Dr. (Hongyun) Huang from (Beijing,) China has been doing work with cells called OEG or olfactory ensheathing glia. They come from the area of the nose that meets the brain."

OSHKOSH — An Oshkosh man accused of having sexual intercourse with a teen murder suspect pleaded no contest to a misdemeanor charge Friday in Winnebago County Circuit Court. David J. Kintopf, 26, made his initial appearance on one count of sexual intercourse with a child older than 16. The criminal complaint states that Kintopf maintained a sexual relationship with Kristen K. Cleaver, an Oshkosh teen who faces trial on a charge with first-degree intentional homicide in the death of her infant. According to the complaint, Kintopf began a sexual relationship with Cleaver in 2002 that lasted into this year. Cleaver, now 18, was 17 years old at the time sexual contact would have begun. Under Wisconsin law, anyone under the age of 18 cannot legally consent to sexual intercourse.

Atlanta attorney, Bill Mitchell filed suit in the Southern District of Georgia in July 2001, naming the school district, board of education, as well as former Superintendent Virginia Edwards, and Gerald Jacobs, the former executive director of human resources. The suit alleged sex discrimination; negligent hiring and retention; and fraud. It stemmed from the rape of a 12-year-old student at the Pearl Smith Learning Center, by Darnique Jefferson who was a long-term substitute teacher. The girl didn't tell her parents what happened, but did confide in her cousins, who eventually told the victim's mother. After the parents went to the police, they found out their daughter was pregnant. The girl had an abortion, and DNA testing on the fetus showed it matched Jefferson's. He pleaded guilty in the spring of 2000 to statutory rape, child molestation and enticing a child for indecent purposes.

Scott Peterson's attorneys claimed in court documents filed Friday that part of California's wiretap law violates the state constitution.
The challenge appears to be the second strike in trying to get wiretap evidence thrown out in the Peterson double-murder case. Also Friday, attorneys for television networks filed more than 900 pages of documents outlining opposition to keeping the press and public out of Peterson's preliminary hearing, scheduled Sept. 9 before Stanislaus County Superior Court Judge Al Girolami.

CAMDEN -- A Camden woman who allowed her infant son to die of malnutrition was sentenced yesterday to nine years in state prison. Chinyere J. Onuba, 23, pleaded guilty to reckless manslaughter in the death of her 5-month-old son, Gabriel Minerva. She will be eligible for parole in 2011. Prosecutors called the death one of the worst cases of child abuse that had ever occurred in Camden County. A medical examiner concluded that the infant, who died Dec. 13, was "permitted to waste to death."

WOBURN -- A woman who repeatedly defied state orders to close her business was charged yesterday with shaking a 3-month-old to death in what appears to be the first murder charge ever brought against a Massachusetts day-care operator. With her husband and family members sitting behind her, Ann Power, 54, of Reading, pleaded not guilty yesterday in Woburn District Court. She was released on $10,000 bail and declined to comment as she left the court.

A 24-year-old Auburn man who tried to strangle his 18-month-old son was sentenced Friday to more than 16 years in prison. Randell Barnes did not address the court before King County Superior Court Judge Harry McCarthy handed down the 16-year, four-month sentence. McCarthy ordered that Barnes have no contact with the child or the child's mother for life. Christal Collins said her son, Tyler, sustained no long-term injuries from the incident.

SYDNEY, Australia - Euthanasia advocates have tested six cars to find out if those fitted with catalytic converters made them too green for suicide. Exit Australia chose the country's Gold Coast for public testing of carbon monoxide emissions from old and new cars. All but one late-model Japanese car passed the test, rapidly producing a lethal dose of 1 000 parts per million.

KANPUR -- In a bid to encourage family planning, the district administration has formulated a scheme to reward all couples who undergo vasectomy or tubectomy. District Magistrate Arvind Kumar said under the scheme, a lucky draw would be taken out on the forthcoming 'tehsil diwas' where a cycle would be gifted to the male who undergoes vasectomy while a sewing machine would be presented to the woman who adopts tubectomy. Besides, two persons would also be presented with silver coins as consolation prizes.
