Harlan Drake Biggest Witness Against Himself In Murder Trial

The biggest murder trial in years in Shiawassee County may have pivoted on Drake’s own words to jurors. With his fate hanging in the balance, the 34-year-old former truck driver cracked jokes and matter-of-factly described how he gunned down anti-abortion activist James Pouillon and gravel pit owner Michael Fuoss on Sept. 11, 2009. . . . Shiawassee County Prosecutor Randy Colbry called Drake’s testimony "chilling." ``Chilling because of his lack of any remorse or feeling with regard to killing these men," said Prosecutor Randy Colbry.

CORUNNA -- Prosecutors called Dr. Charles Clark, a forensic psychologist, to the stand to wrap up their rebuttal of Harlan Drake's insanity defense Wednesday. Clark was hired by the Prosecutor's Office to evaluate Drake at the Shiawassee County Jail in December, and testify about his findings regarding whether Drake was legally insane when he shot and killed Jim Pouillon and Mike Fuoss Sept. 11, 2009. “In my opinion, Mr. Drake was not mentally ill on that date, or as far as I can tell, on any other date,” Clark said. According to Clark, Drake told him during the evaluation that he had suffered 37 to 38 concussions, had been involved in 34 to 35 car crashes, was involved in nearly 1,000 bar fights while he worked as a bouncer at bars, and received roughly 2,300 stitches throughout this life. Although Clark did say that one of the tests he ran on Drake might have shown that Drake was exaggerating during the interview, he also said concussions may, or may not, leave permanent brain damage.
