Abortionist Says She Didn't Work Full Time for Tiller

Under Kansas law, women having abortions after the fetus has been termed viable need two medical opinions that giving birth would cause irreversible harm to the mother. Kristen Neuhaus, who ran a practice in the Lawrence area, said she only came to Wichita to do consultations at Tiller's clinic once a week for half a day. ... Earlier in the day, Tiller's defense team gave a preview of its position during arguments before Sedgwick County District Judge Clark Owens. Dan Monnat told the judge this morning that he intends to present that Tiller tried to comply with late-term abortion laws by getting advice from the Kansas Board of Healing Arts and a private attorney. Monnat indicated that Tiller was acting under approval of both his attorney and the state's medical licensing board when he sought second opinions from Kristen Neuhaus, another physician. Owens said he would determine later whether that evidence will be admissible. The judge said the law allows advice of counsel or "ignorance of the law" to be used as a defense in a limited number of cases.

WICHITA, Kan. -- The defense in the trial of 1 of the nation's late-term abortion providers says the Kansas Board of Healing Arts approved of his relationship with a referring physician. Dr. George Tiller is charged with 19 misdemeanors alleging he failed to obtain a second opinion for late-term abortions from an independent physician, as required by Kansas law. Defense attorney Dan Monnat told jurors in opening statements Monday that board former director Larry Buening first suggested to Tiller that he get Dr. Kristen Neuhaus for that second opinion. He also says Tiller's attorneys told him it was legal.
