Doctor 'Failed To Get Legal Consent For Late-Term Abortion'
A Melbourne doctor has been accused of unprofessional conduct after he performed a late-term abortion on an intellectually disabled woman who was raped by her father. Dr Mark Schulberg, a controversial late-term abortion specialist, fronted the Medical Practitioners Board over allegations he performed the termination at 26 weeks without gaining legal consent. It is alleged he also failed to contact police about the woman's pregnancy when he should have known she was incapable of consenting to sexual intercourse. Under Victorian law, the guardian of a woman with an intellectual disability cannot give consent on her behalf for an abortion. Instead, they must apply to the Victorian Civil and Administrative Tribunal for permission.
