Judge Rejects Planned Parenthood Lawsuit Over Chemically 'Induced' Abortions

A Jackson County judge on Friday ruled against Planned Parenthood of Kansas and Mid-Missouri in a lawsuit over how to regulate Missouri abortion clinics. Planned Parenthood had challenged a state law that said abortion clinics must meet the same standards required of ambulatory surgical centers. In a brief order, Judge Jay A. Daugherty ruled in favor of Jane Drummond, director of the Missouri Department of Health and Senior Services, whose lawyers had argued that the legislature clearly meant to regulate abortion clinics under the law, even those that provided medication abortions using drugs, such as RU-486. "Essentially, the judge said the law means what it says,” said Dale Schowengerdt, a lawyer representing Drummond. “Medication abortions are covered just like any other."

Kansas City -- A Jackson County judge dealt a setback Friday to an effort by Planned Parenthood to overturn a new Missouri law that tightens oversight of abortion clinics. Attorneys for Planned Parenthood of Kansas and Mid-Missouri Inc. argued at a hearing before Circuit Judge Jay Daugherty that Missouri's law is vague since it doesn't include the words "medical abortion," but instead refers to "induced" abortions. Attorney Dale Schowengerdt of the Alliance Defense Fund called the state's intent clear. "I don't think anyone can dispute that 'induced' refers to medically induced procedures," he told the court. "There's no ambiguity."
