Man Charged With 'Abortional Act' In Woman's Beating

ALBANY, New York -- A New York state man was being held on the charge of abortion in the beating of his pregnant ex-girlfriend even though the baby survived, police said on Friday. Tavious Hooks, 25, of Albany, was ordered held without bail on Thursday in the Albany County Jail in upstate New York. Police say Hooks punched and kicked Lucianna Best, 23, inside his apartment on January 21, when Best was nine months pregnant. The woman fled the apartment and went to a hospital after feeling abdominal pains. Doctors induced labor to prevent a miscarriage, and she gave birth. Although the baby survived the attack, Hooks was still charged with abortion in addition to assault. "The law states that anyone committing an abortional act in which the intent is to cause a miscarriage, regardless if whether the person has a miscarriage or not, they can be charged with that felony," said James Miller, spokesman for the Albany Police Department.
