Abortion-Hospital Contracted Funeral Director To Dispose Of Born Alive Babies; Funeral Director Charged With Abusing Corpses

PITTSBURGH -- An ex-funeral director was charged Wednesday with abusing the corpses of 19 babies whose remains were found in the garage of his old home. Robert B. Winston Jr., 61, will not face charges for the scores of dead babies from abortions authorities found in the garage. The criminal charges involved babies that were born alive. Winston, of McKeesport, had a contract with MAGEE-WOMENS HOSPITAL to dispose of the babies by having them cremated. Winston was paid $45 each to dispose of the remains of aborted babies older than 16 gestational weeks, and $1 per pound to handle the others. Authorities said more than 300 fetuses were found.

THE "BORN-ALIVE INFANTS PROTECTION ACT"
Overview:
The Born-Alive Infants Protection Act states that any baby that has been born alive is to be legally considered a person. As such, she or he would automatically be granted full protection under the U.S. Constitution. Other existing laws require that newborns must receive medical attention as needed. Killing a born-alive infant would be considered murder.

Former McKeesport Funeral Director Charged With Abusing Corpses
McKeesport -- Robert Winston, Jr., of McKeesport, is charged with 19 counts of abusing a corpse as well as one count of theft by deception. The former funeral director is accused of neglecting to properly dispose of the remains of fetuses. Initially, 352 fetal remains were documented in the case, but only 19 counts of abuse of a corpse were filed. KDKA's Harold Hayes reports that Winston also faces a charge of theft by deception.

Ex-Funeral Director Held In Abuse of Baby Corpses
As soon as they set foot in the McKeesport garage of a former funeral director, investigators knew they were dealing with death. The odor was awful. And the stacked boxes from which the smell was emanating were clearly labeled as fetal remains. But it wasn't until the Allegheny County coroner's office opened the boxes that they learned some of the remains were not fetuses. They were actually babies -- 19 in all -- who had been born and had lived for a short time. Their tiny diapers and caps gave it away.
