Saying no state law was broken, prosecutors dropped charges this week against a Hot Springs mother, Natasha Faye Spainhour, 25, who was arrested in April after giving birth to twins who reportedly had methamphetamine in their systems. Steve Oliver, prosecuting attorney for the 18th Judicial District-East, said the charge, which his office dropped Tuesday, was not appropriate because the statute cited in Spainhour’s arrest affidavit does not apply to unborn children. "That statute was never intended for this type of charge," said Oliver, who added that, except in cases of homicide, Arkansas law does not define an unborn child as a "person" for the purpose of criminal prosecution.
