Pendergraft To Accept Perjury Plea
OCALA -- Nearly four years after his arrest, Dr. James Scott Pendergraft IV is about to accept a plea deal likely to close the federal government's conspiracy case against him. According to documents filed in federal court Friday, Pendergraft, the owner of the Ocala Women's Center and four other Florida clinics which provide abortion services, was convicted in Ocala, Florida February 2001 of attempted extortion, conspiracy and mail fraud, following a month-long federal trial. Pendergraft and federal prosecutors have reached a plea agreement that will allow the operator of the Ocala Women's Center to plead guilty to one count of "making a material false statement" that "knowingly and willfully assist(ed) . . . Michael Spielvogel, in order to hinder and prevent (Spielvogel's ) trial and punishment." Under the terms of the proposed agreement, Pendergraft could face a possible maximum prison term of 2.5 years, a possible fine of $125,000 and three years of supervised release. [But] the proposed agreement notes that [Bush's] federal prosecutors will recommend a sentence at the low end of federal guidelines.

OCALA - The judge presiding over the upcoming retrial of Dr. James Scott Pendergraft IV has rejected some of the evidence from Pendergraft's first trial. U.S. District Judge Timothy J. Corrigan ruled Monday that some audio tapes of conversations that Pendergraft or his business associate Michael Spielvogel had with former Marion County Commissioner Larry Cretul won't be admitted when Pendergraft's retrial begins next week. Corrigan also ruled some correspondence between Cretul and Pendergraft irrelevant to the retrial.

The white population in America is in decline. The question for Black Americans is do they wish to accompany them? If the black abortion rate remains constant, it may be inevitable. The Black population in America, according to the 2000 Census, comprised 12.3% of the population (12.9% if identified as black plus another race.) It is no longer the largest minority having been surpassed by Hispanics in 2000 (5 years sooner than anticipated.) Black American women comprise 13.5% of the female population in the U.S. but have 34% of all the abortions. Black abortion rates are approximately 2.6 times higher than the white. Most of America's abortions take place in urban areas.

California Judge Rules Against
Ban on 'Partial-Birth' Abortion

SAN FRANCISCO -- A federal judge in California has declared unconstitutional a federal law that attempts to ban certain medical procedures that abortion-rights opponents call "partial-birth" abortions. Federal District Judge Phyllis Hamilton of San Francisco, in a decision handed down June 1, ruled the law -- passed last year by Congress and signed into law by President Bush -- was unconstitutionally vague in its definitions of the acts and procedures it prohibits. LINCOLN, Neb. -- The judge presiding over a challenge in Lincoln of the Partial-Birth Abortion Ban Act said he will rule by Aug. 31. U.S. District Judge Richard Kopf Wednesday heard closing oral arguments from both sides in the Lincoln case. Trials also have been held in New York and San Francisco. A judge in the California trial already ruled the law signed last year by President Bush is unconstitutional. Those sentiments were echoed in a statement released by the Archbishop of Newark Wednesday. The university has come under fire for awarding Judge Maryanne Trump Barry the Sandra Day O'Connor Medal of Honor, named after the associate justice of the U.S. Supreme Court. A federal appeals court panel decided last week to allow a state law requiring women to wait 24 hours before undergoing an abortion. The law became effective immediately. As a result, dozens of abortions scheduled across the state were postponed last week, according to various news sources. The Eighth U.S. Circuit Court of Appeals dissolved Judge Scott O. Planned Parenthood opposes wait period

JEFFERSON CITY -- Abortion provider Planned Parenthood has asked a federal appeals court to clear a procedural path for it to again try to stop the enforcement of a new state law requiring a 24-hour wait for abortions. The court filing yesterday came after a decision last week by the Eighth U.S. Circuit Court of Appeals in St. Louis to lift a temporary restraining order against the law. The restraining order had been in place since October. Planned Parenthood said that by lifting the restraining order and allowing the law to take effect the appeal is now essentially moot. The group wants the appeals court to send the case back to federal district court, where Planned Parenthood could argue for a preliminary injunction against the law.

Breast Cancer-Abortion Study Flawed
While many abortion advocates are touting a recent study in the Lancet which denies the link between abortion and breast cancer, a leading expert in the field now says that the study has serious flaws. Dr. Joel Brind, president and co-founder of the Breast Cancer Prevention Institute, charges that the Lancet study incorrectly compares rates of breast cancer among women who have had abortions with women who have never been pregnant.

The father of the pregnant teenager who was repeatedly kicked in the stomach by former junior Warriors player Shaun Metcalf says the team management has apologised for what happened.
